A state police background check is based on the criminal history of a person with a particular name and involves linking the person to the fingerprints. In other background checks, there is a possibility of confusion because two persons are likely to have a common name. Therefore, depending only on name or on fingerprints is not favourable. A state police background check refers to both the name and the fingerprints available.

The police department of the state involved retrieves the state criminal records from the database. The database connects all arrests with the fingerprints and not merely by name. If anyone with a criminal record is arrested under a false name, then the fingerprints of the arrested person will be linked to the previous criminal history, despite the false name given at that time. In case a criminal charge appears on a particular person, and the person denies that it was not his or her arrest, then the person can give his or her fingerprints to the law enforcement officer and fingerprints can be compared to the false arrest. The state police records are based on fingerprints, and not only on court records.

A state police background check reveals a person criminal conviction record, any pending trials on arrests and whether the person is a sex offender. The check can be conducted with the help of accurate information regarding the person such as name, race, date of birth, gender, social security number, etc. This information can be obtained from the person driving license or identity card. A signed release is also needed from the person which is filed safely for three years. A finger print card can be collected from the police department, on which the fingerprints of the person are to be taken. This finger print card is then given to the police department, which checks its criminal records. Volunteer agencies are not allowed to directly access the FBI report.

The online form for requesting a state police background check includes the requestor name and e-mail address, reason for request, name of the subject and social security number of the subject. The form asks whether:

? the subject has not signed the authorization letter and knows that the background check is being conducted on him or her

? the subject does not know that a background check is being conducted on him or her and the information should be kept confidential
